O'Brien left Westmeath for America when he was twenty years old and soon thereafter joined the United States Army, serving at Fort Laramie in the Wyoming Territory. In 1856 he married Anne Bohan of Brooklyn and in October left for New Orleans and subsequently Arkansas. In 1862 he was appointed a lieutenant in the Confederate Army. On New Year's Eve, 1862, his unit participated in the Battle of Murfreesboro, Tennessee, in which he was wounded and captured by the Union soldiers.
